1. The legal grounds for personal data protection in Bosnia and Herzegovina

The most important act regulating data protection in Bosnia and Herzegovina is Law on Protection of Personal Data ("Official Gazette of Bosnia and Herzegovina" 49/06 with amendments, available in English at http://www.azlp.gov.ba/index.php?type=1&a=pages&id=2). Its provisions are specified in several executing acts. Competencies of the Personal Data Protection Agency in Bosnia and Herzegovina are described in Regulation on procedure upon complaint by the data subject issued to the agency for personal data protection ("Official Gazette of Bosnia and Herzegovina" 51/09).

2. The legal position of the Personal Data Protection Agency in Bosnia and Herzegovina

According to the Art. 35 of the Law on Protection of Personal Data Personal Data Protection Agency in Bosnia and Herzegovina is "an independent administrative organization established for the purpose of ensuring the protection of personal data". It is headed by the Director which appointed by and responsible to the Council of Ministers.

3. The legal rights of the Personal Data Protection Agency in Bosnia and Herzegovina

The main competencies contained in Art. 40 of the Law on Protection of Personal Data ("Official Gazette of Bosnia and Herzegovina". According to it:

(1) Tasks falling under Agency's competence are:

  1. To supervise the implementation of this Law and other laws on personal data processing;
  2. To act on data subject's complaints;
  3. To submit to the Parliamentary Assembly of Bosnia and Herzegovina annual reports on personal data protection;
  4. To follow the personal data protection requirements by giving proposals as to enacting or amending legislation governing the data

processing, give opinions on the proposed laws and take care of fulfilment of the criteria relevant to data protection originating from international treaties that are binding for Bosnia and Herzegovina.

(2) The Agency shall have powers to:

  1. Perform supervision, through inspection, over fulfilment of obligations stipulated by this law;
  2. Keep the Central Registry;
  3. Accept incentives and complaints of citizens concerning breaches of this Law;
  4. Adopt implementing regulations, guidelines or other legal documents in line with the Law;
  5. Order blocking, erasing or destroying of data, temporarily or permanent ban of processing, issue warning or reprimand to the controller;
  6. File a request for filing the misdemeanour proceedings pursuant to this Law;
  7. Provide advice and opinions in the area of personal data protection;
  8. Co-operate with similar authorities in other countries;
  9. Exercise other duties as foreseen by law;
  10. Supervise the transfer of the personal data out from Bosnia and Herzegovina.
